Is data processing taxable in Kentucky?
Probably taxable at 6%, and AgentTax collects. Kentucky has no data-processing category, but API access to seller-hosted AI software fits its definition of prewritten computer software access services. The question has not been litigated.
| Short answer | Taxable at 6% (not settled) |
|---|---|
| Authority | KRS 139.200(2)(ax); KRS 139.010(35) |
| Last reviewed | 2026-08-17 |
Why
KRS 139.200(2)(ax) taxes prewritten computer software access services, defined in KRS 139.010(35) as the right to access prewritten software the seller keeps, taxable regardless of whether the charge is per use, per user, per license or by subscription. An API credential billed per call fits that language.
The Department of Revenue's Kentucky Sales Tax Facts (Winter 2025/2026) says AI applications whose output adapts to user-furnished data are not custom software and remain taxable.
The counter-argument, that the buyer is purchasing processed output rather than software access, is unlitigated in Kentucky. This is not a settled answer.
Business vs. consumer buyers
AgentTax applies the same answer to business and consumer buyers here. Only a few states change the answer by buyer: Iowa and Washington exempt some business purchases by statute, and Maryland and Ohio split the rate or taxability by use.
Where the line is
- A pure service-bureau arrangement, where the customer sends data and gets back results with no access to the software, leans exempt. Get advice on those facts.
How AgentTax classifies data processing
Processing data the customer furnishes and returning the processed result: compute, transformation, analysis and API calls that operate on the buyer's own data. AgentTax routes compute work, API access and data processing to its data processing category.
