Are professional services taxable in Texas?
Generally no. Texas taxes only the services listed in Tax Code §151.0101, and management consulting is not on the list. AI-agent advisory work is a different case that Texas's own rules point toward taxing.
| Short answer | Not taxable (unless enumerated) |
|---|---|
| Authority | Tex. Tax Code §151.0101; Comptroller Pub. 96-259; 34 Tex. Admin. Code Sec. 3.330(a)(1)(C)(iv) |

Why
Tex. Tax Code §151.0101 is a closed list of taxable services. Management consulting is not enumerated and is exempt (Comptroller Pub. 96-259).
AgentTax does not apply that exemption to AI-agent consulting: it routes that work to its digital service category, which Texas taxes on 80% of the price. 34 Tex. Admin. Code Sec. 3.330(a)(1)(C)(iv) and its examples support that routing in Texas's own words.
Business vs. consumer buyers
Because Texas does not tax this category, buyer type does not change the answer.
Where the line is
- Services that fit an enumerated category, such as data processing, are taxable even when sold as consulting.
How AgentTax classifies professional services
Advisory and consulting work performed by people: legal, accounting, management consulting and similar services. AgentTax routes AI-agent consulting work to its digital service category, not to professional services, because an AI agent has no licensed practitioner behind it.
