Is SaaS taxable in Kansas?

Not taxable

No. The Kansas Department of Revenue has said SaaS service charges are not taxed in the first place. Prewritten software is still taxable however it is delivered.

Why

KDOR Opinion Letter O-2012-001 concludes that tax is not imposed on SaaS service charges in the first place, and the department's EDU-71R publication supports the same result.

Kansas taxes a closed list in K.S.A. 79-3603. Prewritten software is on it, whether installed or delivered electronically, but remote access to software the buyer never receives is not.

Business vs. consumer buyers

Because Kansas does not tax this category, buyer type does not change the answer.

How AgentTax classifies SaaS

Remotely accessed software sold by subscription or per use: the customer runs the seller's hosted application and never receives a copy. AgentTax routes SaaS and general AI-agent output (content and consulting work) to its digital service category.
