Why

La. Act 10 (2024 3d Ex. Sess., HB 8) extended the state sales and use tax to digital products and services, including SaaS, effective 2025-01-01.

La. Act 11 (HB 10) set the state rate at 5% from 2025-01-01, up from 4.45%, with a scheduled step down to 4.75% on 2030-01-01. Parish taxes are added on top.

Information services were brought in by the same act on the same date and are taxed the same way.

Business vs. consumer buyers

AgentTax applies the same answer to business and consumer buyers here. Only a few states change the answer by buyer: Iowa and Washington exempt some business purchases by statute, and Maryland and Ohio split the rate or taxability by use.

How AgentTax classifies SaaS

Remotely accessed software sold by subscription or per use: the customer runs the seller's hosted application and never receives a copy. AgentTax routes SaaS and general AI-agent output (content and consulting work) to its digital service category.
