Is data processing taxable in Massachusetts?
Genuinely two-sided, and AgentTax collects 6.25%. Massachusetts exempts processing of customer-furnished data, but it taxes the right to use software on a remote server. AI processing sits on that line.
| Short answer | Treated as taxable at 6.25% |
|---|---|
| Authority | 830 CMR 64H.1.3(9)(a); Citrix Systems, Inc. v. Commissioner of Revenue, 484 Mass. 87 (2020) |
| Last reviewed | 2026-08-17 |
Why
The exempt side: 830 CMR 64H.1.3(9)(a) exempts charges for processing data furnished by customers, regardless of how the result is delivered, and its examples are fully automated services.
The taxable side: the same regulation taxes transfers of the right to use software installed on a remote server, and Citrix Systems, Inc. v. Commissioner of Revenue, 484 Mass. 87 (2020) upheld the Department of Revenue on that point. No Massachusetts authority addresses automated or AI processing directly.
With authority on both sides, AgentTax collects 6.25% and discloses why. Cloud storage and raw cloud infrastructure have been resolved separately as exempt.
Business vs. consumer buyers
AgentTax applies the same answer to business and consumer buyers here. Only a few states change the answer by buyer: Iowa and Washington exempt some business purchases by statute, and Maryland and Ohio split the rate or taxability by use.
Where the line is
- Taxable if the customer operates or directs the software, buys standing access by subscription or seat, receives a software license, or gets its own work product from operating the tool.
- Exempt only if a fixed processing function runs on customer data, priced per job, with output individual to that customer and no right to use the software.
How AgentTax classifies data processing
Processing data the customer furnishes and returning the processed result: compute, transformation, analysis and API calls that operate on the buyer's own data. AgentTax routes compute work, API access and data processing to its data processing category.
