Why
R.C. 5739.01(B)(3)(e) taxes automatic data processing and computer services only when provided for use in business. OAC 5703-9-46 restates that rule and excludes personal activity from business use.
SaaS routes through the same automatic data processing and electronic information services rule (Ohio Department of Taxation Information Release ST 1999-04), so it follows the same business-use test.
Business vs. consumer buyers
Business buyers are taxed; consumers buying for personal use are exempt. Ohio presumes all sales are taxable until shown otherwise (R.C. 5739.02), so AgentTax taxes an unknown buyer and applies the consumer exemption only when the buyer is explicitly declared non-business.
Where the line is
- Transactions between members of an affiliated group are carved out of the rule; exemption certificates cover that case.
How AgentTax classifies data processing
Processing data the customer furnishes and returning the processed result: compute, transformation, analysis and API calls that operate on the buyer's own data. AgentTax routes compute work, API access and data processing to its data processing category.
